Swapsease Terms and Conditions

1. Introduction and acceptance

These Terms and Conditions ("Terms") apply to your access to and use of Swapsease, including the website, mobile app, and related services at https://swapsease.app. By accessing or using Swapsease, you agree to be bound by these Terms. If you do not agree, you must not access or use Swapsease.

These Terms apply together with our Privacy Policy at https://swapsease.app/privacy.

2. Operator information

Swapsease is currently operated by JL Intelligence / James Leadbeater as an individual operator based in Switzerland, and not yet as a registered legal entity. References to "Swapsease", "we", "us", or "our" mean this individual operator unless and until operation is transferred to a registered entity and these Terms are updated.

3. Eligibility

• You must be at least 18 years old (or the applicable minimum legal age in your jurisdiction) to use Swapsease.
• You must not be prohibited from using the service under any applicable law.
• You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

4. Platform-only role

Swapsease is a technology platform that allows users to create profiles, list homes, browse or swipe, match, chat, and arrange home swaps directly with each other. Swapsease is not a party to any swap, stay, agreement, transaction, communication, or arrangement between users.

Swapsease is not a real estate broker, travel agency, insurer, guarantor, property manager, landlord, tenant, agent, escrow service, mediator, or security provider.

To the maximum extent permitted by law, Swapsease does not own, control, manage, inspect, verify, endorse, or guarantee any property, listing, user, availability, identity, swap, stay, safety, legality, suitability, or outcome.

5. No verification of listings or users

Swapsease does not verify that:

• a listed home exists;
• a user owns, rents, controls, or otherwise has permission to list or swap a home;
• property photos, amenities, location, availability, condition, safety, accessibility, legality, house rules, insurance status, or local compliance are accurate;
• users have passed identity, criminal, ownership, tenancy, insurance, or background checks; or
• any listing or user is genuine, trustworthy, or suitable.

Swapsease does not perform criminal checks, identity checks, ownership checks, rental-agreement checks, insurance checks, or property inspections. You are solely responsible for verifying the other user, the listing, the property, permission to swap, insurance, safety, and suitability before making arrangements.

To the maximum extent permitted by applicable law, Swapsease is not responsible for fake, fraudulent, inaccurate, misleading, unavailable, unsafe, illegal, or misrepresented listings or user information.

6. User-to-user arrangements

All swaps and related arrangements are agreed solely between users. This includes stays, dates, key handovers, cancellations, cleaning rules, guest limits, deposits, reimbursements, damage claims, pets, house rules, and check-in/check-out terms.

Swapsease does not create, supervise, manage, enforce, document, guarantee, or complete these arrangements. You should document important arrangements in writing.

To the maximum extent permitted by law, Swapsease is not responsible if another user cancels, disappears, denies access, provides false information, changes terms, does not follow house rules, causes damage, overstays, or otherwise fails to perform.

7. Property damage, theft, loss, injury, and insurance

To the maximum extent permitted by law, Swapsease is not responsible for property damage, theft, loss of belongings, personal injury, death, accidents, illness, neighbour complaints, fines, penalties, denied access, lockouts, travel costs, alternative accommodation, missed flights, lost vacation time, emotional distress, or any other loss connected to a swap or attempted swap.

You are solely responsible for checking home insurance, personal liability insurance, rental agreements, mortgage agreements, homeowners' association or building rules, landlord consent, local laws, taxes, permits, and safety requirements before participating in any swap.

You should obtain appropriate insurance before participating in any swap.

8. Cancellations and failed swaps

Swapsease does not guarantee that any match, chat, listing, or planned swap will result in a completed stay.

To the maximum extent permitted by law, Swapsease is not responsible for cancellations, failed swaps, no-shows, delayed responses, denied access, changed travel plans, travel expenses, alternative accommodation, or related losses.

Users must arrange cancellation expectations and consequences directly with each other.

9. User obligations

• You must provide accurate, current, lawful, and non-misleading information.
• You must only list homes you are legally allowed to offer for swap.
• You must have all permissions needed from owners, landlords, tenants, co-owners, building managers, authorities, insurers, or other relevant parties.
• You must comply with all applicable laws and regulations in each relevant location.
• You must respect other users, properties, privacy, safety, and agreed house rules.
• You must not use Swapsease for illegal, fraudulent, unsafe, abusive, discriminatory, harassing, or commercial misuse.

10. Prohibited conduct

You must not:

• create fake listings or fake profiles;
• use misleading or manipulated photos;
• provide false location, availability, amenities, ownership, or permission claims;
• impersonate any person or entity;
• commit fraud, scams, phishing, payment scams, or external-link scams;
• ask or pressure users to bypass Swapsease for unsafe or fraudulent reasons;
• harass, threaten, abuse, or discriminate against others;
• use the platform to facilitate illegal activity;
• scrape, crawl, data-mine, run bots, spam, reverse engineer, probe, or attack the security or integrity of the service;
• upload malicious code, malware, or harmful scripts;
• infringe third-party intellectual property, privacy, or other rights;
• post another person's home or data without permission; or
• use the app to arrange paid accommodation where that violates local rules or the purpose of the service.

11. Off-platform communication and payments

Swapsease is not responsible for communication, agreements, payments, deposits, refunds, reimbursements, promises, files, links, or arrangements made outside the app.

You should use caution when sharing personal information, sending money, clicking links, transferring funds, or moving communication to third-party channels.

Swapsease does not provide escrow, payment protection, chargeback protection, travel protection, or fraud reimbursement for user-to-user arrangements.

12. Content and listings

You retain ownership of content you submit to Swapsease, but you grant Swapsease a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, adapt, and distribute your content as reasonably needed to operate, improve, secure, and promote the service.

Private chat messages are not used for public marketing. Public listing content and photos may be displayed in the app and, where reasonable, in promotional materials related to Swapsease.

You represent that you have all rights and permissions required to upload and share your content.

Swapsease may remove, restrict, hide, downrank, edit visibility, or otherwise moderate content at its discretion if we believe it may violate these Terms, law, third-party rights, safety, platform trust, quality, or reputation.

13. Reporting suspicious listings and abuse

You can report suspected fake listings, fraud, unsafe behaviour, illegal content, or misuse to jl@jl-intelligence.com.

Swapsease may investigate, request information, remove content, restrict visibility, suspend accounts, terminate accounts, or take other action at its discretion.

Swapsease does not guarantee monitoring, investigation, resolution, recovery, compensation, or any specific outcome.

14. Account suspension and termination

Swapsease may suspend, restrict, or terminate access to all or part of the service at any time if we reasonably believe a user has violated these Terms, created risk, caused harm, misused the service, or where required for legal, security, safety, fraud, abuse-prevention, or operational reasons.

We may remove listings or content without prior notice where appropriate. You may stop using the service at any time.

Account deletion can be requested in app settings or by emailing jl@jl-intelligence.com with the subject "Account deletion request".

15. Subscriptions and payments

Paid features may be offered through Apple App Store, Google Play, RevenueCat, Stripe, or other payment providers. If you make a purchase, payment processing may be handled by those providers and subject to their terms.

Renewals, cancellations, refunds, billing disputes, taxes, and payment errors may be governed by the relevant app store or payment provider policies. Swapsease does not control third-party refund processes.

To the extent legally permitted, subscription features, free features, usage limits, promotional offers, early-adopter offers, and swipe limits may be added, changed, removed, limited, or discontinued at any time.

16. No emergency service

Swapsease is not an emergency service. In urgent situations you must contact appropriate local emergency services, police, medical providers, insurers, building management, or other relevant authorities.

17. Disputes between users

Users are solely responsible for resolving disputes with each other. Swapsease may, but is not obligated to, provide limited support or information.

Swapsease does not act as a judge, arbitrator, mediator, insurer, debt collector, compensation body, or enforcement authority.

18. Disclaimers

Swapsease is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Swapsease disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant uninterrupted service, error-free operation, security, availability, data accuracy, matching quality, listing quality, user behaviour, swap success, property suitability, safety, legality, or outcomes.

You use the service and participate in swaps entirely at your own risk.

19. Limitation of liability

To the maximum extent permitted by applicable law, Swapsease and the operator are not liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profits, revenue, data, goodwill, opportunity, travel costs, accommodation costs, property damage, personal injury, death, or user conduct, arising out of or related to the service.

To the maximum extent permitted by law, Swapsease's total aggregate liability for all claims related to these Terms or the service is limited to the greater of: (a) the amount you paid to Swapsease in the 12 months before the event giving rise to the claim; or (b) CHF 100 if you paid nothing.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including where required by law for intent, gross negligence, death, personal injury, or mandatory statutory rights.

20. Indemnity

You agree to indemnify, defend, and hold harmless Swapsease, the operator, affiliates, service providers, and representatives from claims, losses, damages, liabilities, judgments, penalties, and costs (including reasonable legal fees) arising out of or related to:

• your listings, profiles, uploads, messages, or other content;
• your swap arrangements and communications with other users;
• your stay at another property or hosting another user;
• your breach of these Terms or applicable law;
• your violation of third-party rights;
• your fraud, misconduct, negligence, or interactions with other users.

21. Privacy

Personal data is handled in accordance with our Privacy Policy at https://swapsease.app/privacy.

22. Changes to service and Terms

To the maximum extent permitted by law, Swapsease may modify, suspend, discontinue, limit, or change any part of the service at any time.

We may update these Terms from time to time. Where legally required, we will communicate material changes in a reasonable manner. Continued use of Swapsease after updated Terms take effect constitutes acceptance of the updated Terms.

23. Governing law and jurisdiction

These Terms are governed by Swiss law, excluding conflict-of-law rules, subject to mandatory consumer protection rights that apply in your country of residence and cannot be waived.

Subject to mandatory consumer jurisdiction rules, the competent courts at the operator's place of residence or registered office in Switzerland have jurisdiction over disputes arising out of or relating to these Terms or the service.
